The Kingdom of Saudi Arabia

Exporters/Importers trading with Saudi Arabia need to comply with the requirements of the Saudi Arabian government’s office, the Ministry of Commerce and Industry (MoCI) Product Conformity Program for their goods to clear customs. Failure to do so can result in severe delays in goods clearance, penalties or even shipments being returned.

The Saudi Product Safety Programme (also referred to as SALEEM) is facilitated by the Saudi Standards, Metrology and Quality Organisation (SASO) which has issued Technical Regulations for certain critical products based on their nature, application, safety and performance aspects. The Technical Regulations include legal clauses that empower the Regulatory Bodies and Market Surveillance Authorities to continuously assess the Regulated Products and if found non-compliant initiate penalties, fines, etc. on those Suppliers who have placed these products in the KSA marketplace. The Technical Regulations issued by SASO include various product certification schemes in accordance with the ISO/IEC 17067 standard.

The Saudi Product Safety Programme includes a two-stage certification process namely Product Certification and Shipment Certification of Regulated Products exported to the Kingdom of Saudi Arabia. To facilitate this certification process, SASO has approved Certification Bodies (CBs) for the various geographical regions (Asia and Australia, Europe, North and South America and Middle East and North Africa (MENA)) to issue the Product Certificate of Conformity (Product CoC) and Shipment Certificate of Conformity (Shipment CoC) for Regulated Products.

Exporting Cosmetics and Perfumes to Saudi Arabia - a Certificate of Conformity is mandatory for Customs clearance

The Saudi Food & Drug Authority Cosmetics and Perfumery Product Certification Programme (SFDA CPPC) is a product conformity assessment scheme with the main objective of ensuring that Cosmetic and Perfumery products imported to the KSA comply with the requirements mandated by SFDA

The Saudi Food and Drug Authority has appointed Conformity Assessment Bodies (CABs) to provide Conformity Assessment Services for exports of these products to the Kingdom. CABs are authorised to issue the mandatory Certificate of Conformity, also referred to as SASO Certificate, which is required for Customs Clearance.

Products shall demonstrate full compliance to SFDA requirements: compliance to GSO 1943, eCosma notification, tamper proof packaging for intimate and oral hygiene products, specific labeling for vials & ampoules.

The Saudi Food & Drugs Authority (SFDA) has implemented the Food Consignment Certificate of Conformity program in order to assure Saudi consumers of the safety and quality of the imported foodstuffs they purchase.

This programme aims, under the supervision and management of the SFDA, to provide safe products to consumers as well as a speedy and direct Customs release of imported foods since the consignments will be verified and certified at the country of origin which allows their fast track clearance.

Food consignments will be subject to audit, inspection and testing prior to shipment. Exporters and importers will need to ensure that regulated food products for the Saudi Arabia market are fully compliant with Saudi Food law and regulations for quality, safety and suitability and they have obtained the Certificate of Conformity prior to shipment.

Consignments arriving to Saudi Arabia without Food Certificates of Conformity will be subject to local testing which will slow the Customs Clearance process while the ones holding Food Certificates of Conformity will follow a fast track to be released by Customs.

Importers and exporters will also have to ensure that their suppliers are informed about the quality and safety requirements for Food products and that their consignments will need to be accompanied by a Food Consignment Certificate of Conformity.

Exports of Used Vehicles to Saudi Arabia require a Certificate of Inspection for Customs Clearance

The programme verifies the conformity of Used Vehicles in the respective exporting countries through a quality inspection prior to shipment. This ensures the vehicles comply with the Technical Regulations applicable assuring Saudi citizens of the quality and reliability of the used vehicles they are purchasing.

Exporters of Used Vehicles to Saudi Arabia are required to provide a Certificate of Inspection for Customs clearance in accordance with Government regulation. This certificate can only be obtained from an Approved Inspection Body and issued through the SABER platform.

The Gulf Cooperation Council (GCC)

The Cooperation Council for the Arab States of the Gulf, also known as the Gulf Cooperation Council (GCC), is a regional, intergovernmental, political, and economic union comprising Bahrain, Kuwait, Oman, Qatar, Saudi Arabia, and the United Arab Emirates. The council’s main headquarters is located in Riyadh, Saudi Arabia.

The GCC Standardization Organization (GSO) works to achieve integration and interdependence between the member states of the GCC in the areas of organizing and unifying standardization activities and following up on their implementation to ensure the safety of products, the efficiency of services, and ease of transfer in the Gulf common market.

The technical regulation for Gulf Conformity Marking (G-Mark) was developed to reduce the technical barriers of trade and facilitate the free movement of commodities across borders within the GCC member states. The G-Mark is not a quality mark, but rather a mark that signifies the conformity of products at least to the essential requirements of health, safety and the environment. Affixing of the G-Mark is compulsory for products categories that are the subject of GCC Technical Regulations (currently Toys and Low voltage Electrical Equipment).

The technical regulations determine the conformity assessment procedures that should be applied by the manufacturer and/or importer. A Notified Body, acts as a third-party representative of the manufacturer/importer to carry out the conformity assessment procedures

Mutabaq is a GSO electronic platform that serves the needs consumers, manufacturers and other relevant parties by providing information and services related to the issuance of Gulf Conformity Certificates and product labels for vehicles and tyres

In addition, the website provides services for

  • - Accessing vehicle recall data via Vehicle Identification Number (VIN)
  • - Customs clearance guide, and consumer guide for vehicles, motorcycles and tyres.

The Oman Directorate General for Standards and Metrology (DGSM) of the Ministry of Commerce, Industry & Investment Promotion of the Sultanate of Oman, has implemented a Technical Regulation for Low Voltage Electrical Equipment and Appliances under the new Omani Conformity Scheme, which came into force on June 5th, 2022.

Products subjected to these regulations need to obtain certification from a Notified Body designated by the DGSM.

Regulated products in Stage 1 cover dishwashers, washing machines, and vacuum cleaners. Manufacturers are required to apply for the Omani Type Examination certificate from a Notified Body. These products must undergo safety and EMC tests, and the manufacturer must prepare product design and risk analysis documentation. Conformity certificates are valid for one year and subject to annual renewal.

Halal Certification confirms that products are compliant with Islamic/Shariah standards. Halal products follow specific rules for production, slaughter and other quality standards set by Islamic Sharia. The certification process includes the testing and inspection of products, quality management systems, manufacturing process, and factories to determine compliance.

Harmonized Halal Standards for the Middle East region are issued by the GCC Standardization Organization (GSO), and cover a variety of aspects for Halal product/manufacturing compliance including:

  • - Halal Food - Part 1 : General Requirements (GSO 2055-1:2021)
  • - Halal Products – Part 4 : Requirements For Halal Cosmetics And Personal Care (GSO 2055-4:2021)
  • - Halal Feedstuff (GSO 2578:2021)
  • - Halal Medical Device – General Requirements (GSO 2680:2021)
  • - Additional GSO standards related to compliance with Halal manufacturing processes, management systems, retailing, warehousing and transport

The Middle East and North Africa (MENA)

The Middle East and North Africa (MENA) region includes 21 countries stretching from Morocco in the west to Iran in the East and includes major trading partners with the U.A.E. such as Iraq, Egypt and more recently, Israel.

With vast reserves of petroleum (60% of the world oil reserves) and natural gas (45% of the world natural gas reserves), the MENA region is a source of global economic stability Further information on the requirements for export to the Kingdom of Saudi Arabia and the Gulf Cooperation Countries (GCC) can be viewed on their specific pages

Manufacturers or Trademark Owners of regulated products, including garments, cosmetics, detergents, electrical appliances and toys must register with Egypt’s General Organization of Export and Import Control (GOEIC) to export to Egypt.

Regulated product consignments must be verified for compliance to relevant Egyptian Organisation for Standardisation (EOS) and Quality Control sanctioned standards. A Certificate of Conformity (CoC) must also be obtained from a third-party inspection company for Customs clearance. The compliance verification process will involve physical inspection of the consignment, and if necessary, sample selection for testing purposes.

Egypt’s National Food Safety Authority (NFSA) food conformity assessment programme launched in 2020 with the aim of protecting the health and safety of Egyptian consumers by enforcing minimum requirement standards for food exported to Egypt. NFSA regulates food and food contact material safety through the issuance of Certificates of Inspection (CoI) by the process of documentary verification, laboratory testing at NFSA approved laboratories and physical cargo inspection in the exporting country

From the 1st January 2020, the Iraq The Central Organization for Standardization and Quality Control (COSQC) requires exporters trading with Iraq to comply with the requirements of pre-shipment inspection/testing programme for goods, which mandates that shipments require a Certificate of Conformity (CoC) in order to clear customs.

The Conformity Assessment Programme verifies the conformity of all Regulated Products to Iraqi Standards in the respective country of supply which includes but is not limited to: Food, Toys, Electrical and Electronic Appliances, Vehicle Spare Parts, Vehicle Tyres, Chemicals, Cosmetics and Perfumery Products, Tobacco Products, Construction and Building Materials, Kitchenware, Stationery, Baby Care Items, Textile products and Lubricants

The Ministry of Industry, Trade, Green and Digital Economy (MICEVN) has implemented of the Verification of Conformity (VoC) program applicable to products imported into Morocco in pursuance of the Law 24-09 related to products and services security.

Regulated Product Categories under the VoC program include Automotive spare parts, oil and gas appliances, construction materials, leather, textiles and clothing, chemical products, plastic products, toys, food contact materials, home appliances and Personal Protective Equipment (PPE). Some product categories are additionally subject to inspection on arrival in Moroccan Customs

All regulated products shall be subject to verification and shall be accompanied by a certificate of conformity for Customs clearance in the Kingdom of Morocco.

Three product categories covered by Law 24-09, Low voltage Electrical Equipment, Equipment affected by electromagnetic compatibility (EMC) and toys are additionally subject to mandatory Cم Marking

The Israeli Ministry of Economy and Industry has recently approved a major reform of import requirements intended to facilitate trade and to remove trade barriers. It includes two main principles:
1. Products that comply with the regulations in major advanced countries should be good for Israel as well.
2. The methods of enforcement should be based on importers declaration alongside smart and effective market surveillance.

This reform is implemented differently for different products and includes changes in the regulation for food, cosmetics, electric home appliances, and many other products that need to comply with official Israeli standards.

The European Union (EU)

Standards and technical specifications for a number of product categories are harmonised in the EU. This means that the same rules apply in all EU countries. Rules are applied to product groups, such as toys, or product characteristics, such as electromagnetic compatibility.
Where no EU-wide rules exist, national specifications might apply in different EU countries. In such cases, products must only comply with the rules valid in your export destination EU country

Access2Markets Contains detailed information needed when trading with EU countries, such as on tariffs, taxes, procedures, formalities and requirements, rules of origin, export measures, statistics, trade barriers.

It also provides access to key information needed for trade in services as well as for investment and procurement in the EU, EU trade agreements, how to benefit from them and stories on successful companies using them.

The ‘My Trade Assistant’ Tool in the Access2Markets website allows searching for General and Specific Import Requirements for products based on their HS code number, and includes details of the products Tariffs, taxes and trade flow statistics

The EUR-Lex website contains a database of all current, past and under development legislation in the European Union, including legislation relevant to the conformity and standards of products imported into the EU.

Types of Legislation include:
Regulations, which are binding legislative acts that must be applied in their entirety across the EU
Directives, which are legislative acts that sets out goals that all EU countries must achieve. However, it is up to the individual countries to devise their own laws on how to reach these goals.
Decisions, which are binding on those to whom it is addressed (e.g. an EU country or an individual company)
Recommendations and Opinions, which are non-binding instruments

Harmonized European standards are developed by request of the European Commission by one of the three European standardisation organisations (ESOs):

European Committee for Standardisation (CEN)
European Committee for Electrotechnical Standardisation (Cenelec)
European Telecommunications Standards Institute (ETSI)

Manufacturers, other economic operators, or conformity assessment bodies can use harmonised standards to demonstrate that products, services, or processes comply with relevant EU legislation.The harmonised standards are published in the Official Journal of the European Union (OJEU)

A main objective of the European Commission is to bring product harmonisation legislation and related non-legislative acts in line with the reference provisions of Decision 768/2008/EC. A list of directives, regulations and delegated act which are now aligned with, or based on, these reference provisions can be accessed here

The letters ‘CE’ (standing for ‘Conformité européenne’ which is French for ‘European Conformity’) appear on many products traded in the extended Single Market of the European Economic Area (EEA). By affixing the CE marking to a product, a manufacturer declares that the product meets all the legal requirements for CE marking and can be sold throughout the EEA.

CE marking is a part of the EU’s harmonisation legislation. Comprehensive guidance on the implementation of EU product rules can be found in the so-called Blue Guide

Manufacturers must follow these 6 steps to affix a CE marking to their product

  1. Identify the applicable directive(s) and harmonised standards.
  2. Verify product specific requirements
  3. Identify whether an independent conformity assessment (by a notified body) is necessary
  4. Test the product and check its conformity
  5. Draw up and keep available the required technical documentation
  6. Affix the CE marking and draw up the EU Declaration of Conformity

The United Kingdom (UK)

With the recent exit of the United Kingdom from the European Union (Brexit), the previously applied EU laws regulating product safety and performance have changed.

From the January 1st 2021, new UK Laws regulating the safety and performance of certain products were introduced, from medical devices to machinery, electrical equipment to construction products.

These laws included, in some cases, the replacement of CE marking for products with the UKCA (United Kingdom Conformity Assessed) marking, replacement of EU product regulations and directives with corresponding UK regulations and replacement of harmonized EU standards with BS, EN or EN/ISO/IEC Designated Standards.

The UKCA scheme has been operational since Jan 1st 2021 and very closely resembles the European Union CE scheme. In almost all cases wherever you are required to affix a CE mark on products for the EU market, such as toys, measuring instruments, low voltage electrical equipment and machinery, you can now also affix a UKCA mark for the UK market. The UK Government will continue to recognise use of use either UKCA or CE markings in Great Britain until 31st December 2024.

Some products, including medical devices, construction products, cableways and energy using products, are covered by the UKCA marking but have some additional special rules for which sector-specific guidance should be sought

The UK Market Conformity Assessment Bodies (UKMCAB) database serves as a register of UK Government appointed Conformity Assessment Bodies who can certify goods for both the GB and NI markets

A designated standard is a standard, developed by consensus, which is recognised by the UK government in part or in full by formally publishing its reference on www.gov.uk. Links to product specific designated standards and notice of new or amended standards are provided by the Office for Product Safety Standards (OPSS) and Department for Business, Energy & Industry Strategy.

From 1 January 2021, the UK regulatory framework enables the relevant Secretary of State to ‘designate’ standards for regulatory conformity purposes. The government ensures that the standards designated for the UK market meet the required levels of safety or energy efficiency.

Designated standards can help manufacturers demonstrate their products comply with UK law. By following designated standards, manufacturers can claim, ‘presumption of conformity’ (which can be countered by evidence) with the corresponding product essential requirements set out in UK legislation. Designated standards do not replace the essential requirements and manufacturers retain full responsibility for ensuring the applicable UK law is met.

For the UK market, and depending on the product, a designated standard can be a standard adopted by any of the recognised standardisation bodies; the British Standards Institution (BSI), European Committee for Standardisation (CEN), European Committee for Electrotechnical Standardisation (CENELEC) and European Telecommunications Standards Institute (ETSI)) or by international standardising bodies including; the International Organization for Standardization (ISO), International Electrotechnical Commission (IEC) and International Telecommunication Union (ITU).

The Northern Ireland Protocolcame into force on 1st January 2021 with updated legislation introduced on 13th June 2022. For as long as it is in force, Northern Ireland will align with relevant EU rules relating to the placing on the market of manufactured goods covered under the EU New Legislative Framework.

There are different rules for:
goods still regulated under the old approach such as chemicals, medicines, veterinary medicines, vehicles and aerospace, which are subject to specific arrangements

goods covered by national rules (non-harmonised) that apply in Northern Ireland

certain other goods, such as medical devices and civil explosives

The UKNI marking is a new conformity marking for products placed on the market in Northern Ireland which have undergone mandatory third-party conformity assessment by a body based in the UK. Explanation of how to use the UKNI marking (sometimes referred to as the UK(NI) mark or the UK(NI) indication) is provided in the following guidance.

The Asia/Pacific Region (APAC)

The Asia/Pacific Region (APAC) is a diverse area with respect to languages, religions, cultures and economics. It includes over 50 countries/territories with some of the smallest (Pitcairn Islands, with only 50 inhabitants) to 4 largest (China, India, Indonesia and Pakistan). Consequently, over half of the world’s population can be found in Asia/Pacific, which constitutes over 15% of the Export trade for the U.A.E.

While many of the smaller nations in Asia/Pacific have joined together to harmonize product regulatory, standards and customs requirements or rely heavily on evidence of prior-approval in neighboring developed economies, the major economies such as China, Japan, India and Korea still largely implement product regulations independently.

The China Compulsory Certification (CCC) Program, Administered by the Certification and Accreditation Administration (CNCA) covers over 100 product categories and is similar to other certifications for product quality standardization such as the European CE system. Certification of products can include self-declaration of conformity or voluntary certification such as energy/water saving and green labelling for certain product types.

Certification and CCC Marking of products can also often require submission of product samples for additional testing of products in accredited laboratories in China and factory inspection by Chinese officials.

Product standards applied for the conformity and testing requirements of products placed in the China market (GB/T standards) are governed by the Standardization Administration of the P.R.C (SAC)

The Pakistan Standards and Quality Control Authority (PSQCA) is the national body responsible for which is mandated to establish national standards, operate system and product certification schemes, conduct compliance testing, and disseminate information on standards and technical regulations

Over 160 products currently have a compulsory requirement to meet Pakistan Standards or International Standards, which is facilitated for Foreign Manufacturers through the operation of Conformity Assessment by Foreign Manufacturer License (FML) or Conformity Assessment Report (CAR), for clearance for individual import consignment of mandatory products

Certified products may also be licensed to carry the Pakistan Standards Mark.

The Bureau of Indian Standards (BIS) operates conformity schemes for goods, articles, services systems and processes through a network of Branch and regional offices throughout India.

Product certification involves assessing the Manufacturing and Testing Capabilities of the manufacturer as well as ensuring conformity of the product to the requirements of the relevant Indian Standard(s) through testing to enable use of the Indian Standards Institute Mark (ISI Mark).

The list of products which require compulsory certification to Indian Standards includes:
Products which require Mandatory ISI Marking
Products with require only issuance of a Certificate of Conformity
Products which require only registration through self declaration

The Bureau of Indian Standards also provides a Foreign Manufacturer Certification Scheme (FMCS) for certain products (Electronics & IT Products notified under Compulsory Registration Scheme), which can license a manufacturer for use of the ISI Mark on products with conform to Indian Standards

Australia and New Zealand, while operating as independent economies, share a number of Quality Infrastructure activities including Electrical Standards, Accreditation (JAS-ANZ) and Product Conformity Programs including:

Codemark (NZ) and Codemark (AUS) for building products
Watermark (AUS) for quality, performance and conformity of plumbing products
Equipment Energy Efficiency (E3) Program for appliance energy performance ratings
Regulatory Mark of Conformity (RCM) for safety of electrical equipment
ANZEx Certification system for Hazardous Area Equipment and Services

Regarding the regulation of food imports, The Food Standards Australia New Zealand (FSANZ) is responsible for the Australia and New Zealand Food Standards Code which is enforced by the Australian Department of Agriculture, Fisheries and Forestry (ADAFF) for food imported into Australia and the Ministry for Primary Industries (MPI) in New Zealand.
